Senate Working To Stop Good Pro 2A Bills, and How You Can Help

by Secretary, NHFC on May 23, 2021

Our rights are at risk… again! Biden and Congress are pushing every day to make it harder to purchase and to own a firearm, and now, the ATF is even looking to make criminals out of ordinary gun owners for just simply having a portion of a firearm that does not have a serial number.
This past week the ATF released a new 115 page set of “rules” that are designed to further restrict your Second Amendment rights.  We are reviewing the draconian rules proposed by the ATF and will let you know what we find.
Just so you know how biased the ATF is, years ago they defined a “firearm” as any 80% lower receiver with one additional small slot milled in the trigger area or dimples on the frame to show you where to cross drill for the various pins .  Look at the photo pulled from the ATF website…

Never mind the fact that Congress defined a firearm when they passed the unconstitutional 1968 Gun Control Act:  18 U.S.C. § 921 (a)  “(3) The term “firearm” means (A) any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; (B) the frame or receiver of any such weapon;..” Maybe it’s just me, but I would find it hard to use a 80% lower with a single slot machined into the fire control cavity as an item that “may readily be converted to expel a projectile by the action of an explosive;”, and I personally own the Bridgeport necessary to make the changes. There is nothing that is “readily” convertible about a partially machined AR lower.
Now, Biden is pushing to have the former lobbyist for the Giffords group as the new head of the ATF, someone former Congresswoman Gabrielle Giffords labeled as the “perfect choice”.
Strangely, there are some in New Hampshire that want to give the Federal Government FBI and ATF greater responsibility for who can and who cannot purchase firearms in NH.  Later this week we will be sharing the dangers of one of the Senate bills going through the State House that proposes to give the Federal Government FBI exclusive control over NH gun owners access to firearms from firearms stores.
We need to build a wall at the state level to stop the federal government from continuing to take away our rights…. And this is where we need your help!  The New Hampshire Senate needs to hear from you!
The Senate Judiciary committee will be voting on 6 critical pro-2a bills on Tuesday (5/25) and they need to hear from you tomorrow!  We need the Senators to vote OTP (Ought To Pass) on each of these pieces of legislation. CLICK HERE TO COMPOSE A EMAIL TO THE SENATE

The following bills are in the Senate Judiciary Committee and need to come out with an Ought To Pass (OTP) recommendation and be passed on the Senate floor.HB307 “The 2021 2nd Amendment Sanctuary State Act”  [relative to the state preemption of the regulation of firearms and ammunition.] This bill prohibits local officials from creating local gun free zones without General Court Approval.  This bill expands what was started years ago.  Current law prohibits the creation of local gun free zones, but the statute does not assign a penalty for breaking the law.  Local officials seem to have no regard for willfully violating this statute. This bill will correct those willful violations by adding a penalty.  This is the most important bill that we need your help to pass.HB195 “Ending prosecution for display of a firearm under reckless conduct”  [adding display of a firearm as an exception to reckless conduct.]Simply displaying a firearm is not a crime.  Threatening someone is an action and that is completely different from being charged for your shirt shifting while getting out of a car or reaching for a box of cereal on the top shelf at the grocery store. No one should be forced to spend their life savings to defend themselves in a court fighting a class B felony for a firearm showing under your shirt while you stoop or bend over to pick up something.HB196 “Property protection is not a crime”  [adding trespass as an exception to the charge of criminal conduct.]   This is a bill to prevent prosecution for what Mark and Patricia McCloskey did to protect their property.  No one was hurt when a mob broke through the gates and trespassed on their property, yet the McCloskey’s were charged with a crime and the mob damaging their property was not charged for their criminal acts.HB197 “Expanded Stand your Ground for vehicles” [relative to the use of deadly force in defense of another.]  Current law prohibits you from defending your loved ones sitting in your car.  Under certain conditions when someone is about to commit a felony against you and you are inside your vehicle, you do not have the right to protect yourself or those with you.  This bill would restore that chance to defend yourself and your loved ones without fear of criminal prosecution.HB334 “Constitutional Carry for ATV and Snowmobiles”  [relative to prohibitions on carrying a loaded firearm on an OHRV or snowmobile.] This bill simply solves a small oversight from when Constitutional carry was passed in 2017.  Currently you are prohibited from riding a ATV or snowmobile on your own property while carrying a loaded handgun. HB440 “The 2021 Protect Our Constitutional Rights Act” [prohibiting the suspension of civil liberties during a state of emergency.] Currently the courts have ruled that the executive branch can strip us of our constitutional protections during a declared “state of emergency”. Remember hurricane Katrina? This bill would correct that.

Dear Senate Judiciary Members,

Please vote OTP on ALL the following bills:

HB307 “The 2021 2nd Amendment Sanctuary State Act”  [relative to the state preemption of the regulation of firearms and ammunition.]

HB195 “Ending prosecution for display of a firearm under reckless conduct”  [adding display of a firearm as an exception to reckless conduct.]

HB196 “Property protection is not a crime”  [adding trespass as an exception to the charge of criminal conduct.]

HB197 “Expanded Stand your Ground for vehicles” [relative to the use of deadly force in defense of another.]

HB334 “Constitutional Carry for ATV and Snowmobiles”  [relative to prohibitions on carrying a loaded firearm on an OHRV or snowmobile.]

HB440 “The 2021 Protect Our Constitutional Rights Act” [prohibiting the suspension of civil liberties during a state of emergency.]

It is essential that while we have a legislature that favors our 2nd amendment rights that we undo the damage from years of abuse.

Sincerely,

For Liberty,

JR Hoell, Secretary
New Hampshire Firearms Coalition
