Petition to Stop Unconstitutional Searches by Fish & Game

Whereas: The fourth amendment to the US Constitution clearly states “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated,…” and;

Whereas: Part 1st, Article19 of the New Hampshire Constitution expands upon those protections and succinctly states ” [Searches and Seizures Regulated.] Every subject hath a right to be secure from all unreasonable searches and seizures of his person, his houses, his papers, and all his possessions…” and;

Whereas: in RSA 206:26,XI Fish and Game conservation officers have been tasked with: “To enforce the laws relating to snowmobiles, all terrain vehicles, trespass on posted lands, motor vehicles blocking private ways….”, and;

Whereas: in RSA 206:26,XV Fish and Game conservation officers have been tasked “To enforce all provisions of RSA title XXI relative to motor vehicle laws, absent any violation or suspected violation of fish and game laws, and;

Whereas: in RSA 206:26 Fish and Game conservation officers are allowed to search without warrant and allowed to seize property without warrant, and;

Whereas: New Hampshire Statutes that violate the New Hampshire and United States Constitutions are repugnant to the rights of the citizens of a free country, and;

Whereas: Violating one part of our bill of rights could quickly led to violating other sacrosanct sections that protect the rights of gun owners, and;

Whereas: Citizens carrying firearms while hiking in the woods, driving ATV’s or snowmobiles on trails should be presumed innocent and afforded their full Constitutional protections, and;

Whereas: Due process is a critical part of our Criminal Justice system, and HB498, would restore the constitutional protections that our forefathers fought for;

THEREFORE, BE IT RESOLVED, to protect liberty and the civil rights of individuals to be free from the threat of search and seizure without a warrant, and to honor the oath you took to uphold the Constitutions, we formally REQUEST that HB498 be passed into law.
